This was known ever since the trailer was released about 3 months ago.
It's being Co-Produced by Geneon USA.
IOW, you can go ahead and assume it's licensed.

And it's a great show, BTW. It starts out like the game, but it skips straight to the battle against Dhaos' minions in the snowfield.

Actually, what he said was:
"'Always' is too concrete a term ... so I will have to say 'No' ... as often as we can, maybe ... sometimes, the rights get by us."
And then cited GITS:SAC as an example. (Jubei2 is also a recent example.)

There are two ways to read this:
1) It is 100% that is it licensed, just not 100% that it is by them. (This was my interpretation based on his wording.)
2) That there are some series where the company denies the rights for the US entirely even after they have cofunded.

If I remember correctly, Tenjou Tenge had Geneon Entertainment USA in the credits, and that's not licensed (yet, although the manga already is). I don't think things like the cooperation of Geneon Entertainment USA constitute a licensing (yet).

You mean, it has not been announced by them as being their property. There is nothing that indicates that they do not have it (i.e, their name did not suddenly disappear off the website) and there is no reason that they have to announce it immediately. As was the case with Texhnolyze where it took a few months (even though it appeared on their own webpage!). I have a feeling that the non-announcement of TenTen has something to do with Ikkitousen (or they could just have their plate full, but it would make sense not to release 2 very "similar" series at the same time.)

Wrong way to read it.

First off, as I've pointed out to a few people in the past, "licensed" is actually starting to become an innapropriate term in some cases.

Bandai Entertainment for example did not license Ghost in the Shell: Stand Alone Complex or D.I.C.E., they owned the rights to the shows from the start (but ended up havign to share the GitS rights), so now "licensing" agreement was ever signed. As a member of the production comitee, companies are partial owners of a show, and usually excercise those rights in a specific arena, North American anime distributors obviously seek to excersise their share of the rights by distributing the title in North America. Legal documents more akin to a shareholder's agreement are signed, but these technicly aren't "distribution licenses."

Of course, things can go differently, as Chad pointed out. Sometimes the co-producing company may decide to pass on distributing it and allow it to be licensed to a 3rd party company, or other times prior rights (rights to first refusal or treademarks) might get in the way. This was the case with GitS:SAC.

So we can never assume without question that the co-producer will have the license. Even if no Geneon co-produced anime has yet to be distributed by another company in North America...

The OAV sounds decently fun though. That's judging from the game though. =P
